PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PURCHASING AND USING SOFTWARE OR SERVICES FROM WEBAXOO. BY PURCHASING OR USING WEBAXOO SOFTWARE OR SERVICES, YOU SIGNIFY YOUR ASSENT TO, AND ACCEPTANCE OF, THESE TERMS AND CONDITIONS AND ACKNOWLEDGE YOU HAVE READ AND UNDERSTAND THESE TERMS AND CONDITIONS. IF YOU ARE AN INDIVIDUAL ACTING ON BEHALF OF AN ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO ENTER INTO THESE TERMS AND CONDITIONS ON BEHALF OF THAT ENTITY. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, THEN YOU MUST NOT USE WEBAXOO PRODUCTS, SOFTWARE, OR SERVICES.

Plugin Licensing

WEBAXOO Designs plugins and themes, are licensed under the GNU General Public License (http://www.gnu.org/licenses/gpl.html) version 3.0 or later.

Warranty

We are not responsible for any plugin or theme compatibility conflicts that may occur. The Software is purchased “AS IS” and WITHOUT ANY WARRANTY. We hereby disclaim any and all warranty not expressly provided herein, including but not limited to the warranties of MERCHANTABILITY and of FITNESS FOR A PARTICULAR PURPOSE. You use the Software at your own risk. We are not responsible for any data loss that may occur as a result of installing the Software, and our liability for harm resulting from your use of the Software is expressly limited as provided herein

Support

Support Services for purchased products are available via our support page for all accounts for which there is a current and active Subscription. If you wish to receive support after one year, you must renew your subscription or purchase a new license key. Subscription is subject to 30% of the base price. Support is not available for accounts without an active Subscription. Support requests are handled on a first-come, first-serve basis.

We will undertake Commercially Reasonable Efforts to resolve issues in a timely, courteous, and professional manner. However, we make NO WARRANTY of any kind with respect to the Software or with respect to whether the use of Support Services may resolve any particular issue. You use our Support Services at your own risk. We are not responsible for any harm, including but not limited to data loss, that may occur as a result of using our Support Services, and our liability for harm resulting from your use of Support is expressly limited as provided herein.

Support is available from 10:00 AM to 10:00 PM (+5:30 GMT ) from Monday through Friday except for major holidays. Inquiries received outside of these hours will be addressed in the next immediate business day.

We do not offer support for WordPress, or other WordPress products we have not developed. We commit to keeping our products up-to-date with the latest version of WordPress. As such, all of our products are designed to be compatible with the latest available version of WordPress. We can give no guarantee that products will work with older versions of WordPress.

Automatic Updates

Automatic updates are available to license holders who have an active and valid subscription and license key. Automatic updates are available for plugins and themes both. Automatic updates are available as long as the license key generated from the purchase is valid and active.

License Usage

WEBAXOO grants each customer one or more non-transferable license(s) to use the software for internal use, as defined by the terms set in the customer’s chosen license package for support and updates.
Where the license package allows enabling auto-update and makes the active site eligible for support requests, the customer/license-holder may not sell the originally-purchased license key provided by WEBAXOO, to other users of the license (such as clients) for commercial benefit. Additionally, the customer may not sublicense, to any person or entity, any rights to distribute the license key. WEBAXOO will only provide support services to the original customer/license-holder with a legitimate license key, and consider any other uses of this license key for support queries as fraudulent.

Plugin/Theme Delivery

After we have processed your payment successfully, you will receive an email with your order number and other purchase information. Your license key is available in your account area along with your plugin downloads. You can download the plugin by logging into the account created for you at the time of purchasing the plugin and clicking on the appropriate link.

Should you not receive an email containing your information, you can contact us at https://webaxoo.net/support/ to request your purchase information.
Access to re-download purchased files will be granted so long as your license key is valid. If a license key expires, download access to the associated files will be discontinued until the license key is renewed.

Ownership

WEBAXOO and/or its licensors own and shall retain all rights, titles, and interests, including all intellectual property rights, in and to the products, services, documentation, imagery, and content (including at webaxoo.net) provided under these Terms and all elements thereof.  Except for the express licenses granted to you herein, you neither have, nor acquire, any rights, titles, or interests in or to the foregoing, or any element thereof. In addition, you acknowledge and agree that you will not bundle any WEBAXOO product with any other products (i.e. WordPress themes) to be distributed in online marketplaces

Price Changes

WEBAXOO reserves the right to modify, change, cancel or upgrade a plugin subscription and license key without prior notice or consent. Prices of all products are subject to change without prior notice or consent.

Subscriptions & Automatic Renewal

WEBAXOO extensions are sold as automatically recurring subscriptions that renew each year on the anniversary of the purchase date. This applies to all paid-for plugin and theme licenses.

This subscription will automatically renew at the end of the annual license term unless the purchaser cancels their subscription before the automatic renewal date.

Please note the following details of WEBAXOO extension license subscriptions:

Subscription renewals are automatically processed annually on the anniversary of your original purchase. The license renewal will continue and remain valid for each one (1) year unless the subscription is canceled before the renewal date.

  • You may cancel your subscription at any time from your Account page on the WEBAXOO website.
  • If you choose to cancel your subscription, you will no longer receive updates and support for the extension when your license expires.
  • If you choose to renew your subscription after it has been canceled and your extension license has expired, you will be charged the current listed price for the plugin/theme license. We cannot apply older or initial pricing to your new renewal purchase.

We cannot grant refunds on renewal payments. We will send you an email two weeks before your renewal date, and you may use this opportunity to cancel your subscription before the renewal payment is automatically processed.

If you choose to cancel your subscription, your license will expire on the anniversary of the original purchase, and you will no longer receive updates and support for the WEBAXOO extensions you have purchased.

Refund Policy

We firmly believe in and stand for our products 100%, but we understand that they cannot work correctly for everyone all of the time. If you would like to request a refund, please open a “Refund Request” support ticket. When requesting a refund, we respectfully ask you to make sure you comply with the following refund policy conditions:
Eligibility conditions for a refund request:

  • You are within the first 7 days of the original purchase of the plugin.
  • We cannot grant refunds after the first 7 days of the original purchase.
  • We cannot grant refunds on renewal payments. We will send you an email two weeks before your renewal date, and you may use this opportunity to cancel your subscription before the renewal payment is automatically processed.
  • You have purchased the plugin/subscription, and after installing and testing the plugin, have found that it will not work for your business or required setup.
    OR
  • You have an issue that we are unable to resolve which makes the system unusable. We may ask you questions regarding the nature of your refund request so we can improve the plugin in the future.
  • If your issue(s) comes from not being able to install the plugin correctly or getting the plugin to perform its basic functions, we will happily consider your refund request.
  • You have contacted our support team and allowed us to attempt to resolve your issue(s) or have explained why the plugin will not work for you.
  • Please note, technical issues caused by 3rd party plugins, themes, or other software will not provide grounds for a refund.
  • You agree to deactivate and uninstall the plugin from your site if a refund is granted.

Refunds will be offered at our sole discretion. By purchasing plugin(s) from our site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment, or legal actions. We are not liable to cover any differences in exchange rates between the time you purchased and the time you are refunded.

Email

WEBAXOO may occasionally send you emails related to the purchase of the product(s) from our company. We may also send you occasional email newsletters regarding plugin and theme updates & promotions. We will never sell or release your email to any third-party vendors. You may opt out of these emails at any time without penalty.

License Agreement

By purchasing our product(s), you indicate and consent that you have read and agree to the Terms & Conditions listed and detailed on this page. We reserve the right to change or modify the current Terms and Conditions without prior notice or consent.

We provide support for products purchased from us on webaxoo.com. We do not provide support for anyone that has purchased our products from 3rd parties. You must have an active license to receive premium support. Support can only be provided to the person/company that purchased the license. A license is non-transferable. We will only support the license on the domain you have activated the license on and your staging server. The staging server must be on the same domain name.

Support Times

We aim to respond to premium support questions within 12 hours during the week (Monday – Friday) and 24-48 hours on weekends (Saturdays and Sundays).

Server Access

There will be times when we will require a login to your WordPress install or even your web hosting panel to diagnose and fix issues.

We encourage all our customers to run staging servers so that they can test and develop before publishing this to their website. This ensures your business continues to operate while you test updates or possible issues.

We cannot be held liable for any consequences that may arise from the access you grant us. It is your responsibility to ensure your website’s data integrity, security, and availability. We highly recommend that customers take a complete backup and run a staging server before granting our premium support access.

Bugs

We are continuing to update and advance our products. To this end, there are times when new or existing bugs may come to light. If you find a bug or think you have found a bug please report it to our support team and we will investigate. If this is a security issue then we will work on a bug fix and release it as soon as possible. For other bugs that are noncritical, they will be released in the next version of the software. If you need the bug fixed before this, please request it from support and we will do what we can to accommodate your request.

We do what we can to avoid any bugs in software, but there are times when this is not the case. If you find a bug please report it to the relevant team.
